1. Acceptance of Terms

By accessing or using the EverStories website at www.everstories.ca or placing an order with us, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

We reserve the right to update these terms at any time. Continued use of our website after changes are posted constitutes your acceptance of the revised terms.

2. Our Service

EverStories provides personalized gifting products and services to customers across Canada. All orders are fulfilled on a made-to-order basis. Due to the custom nature of our products, production timelines may vary.

Please note that all orders are currently subject to an extended production window. Estimated timelines are communicated at the time of order and via email confirmation.

3. Orders and Payment

By placing an order, you confirm that:

All prices are listed in Canadian dollars (CAD) and include applicable taxes where required. Payment is processed securely at the time of order. We reserve the right to cancel any order at our discretion, in which case a full refund will be issued.

4. Cancellations and Refunds

Due to the custom and handcrafted nature of our products, all sales are final once production has begun. If you wish to cancel an order, please contact us within 24 hours of placing it at info.everstories@gmail.com.

If your order arrives damaged or there is an error on our part, we will work with you to make it right. Please contact us within 7 days of receiving your order with details and supporting photos.

We do not offer refunds for change of mind once production has commenced.

5. Content You Submit

By submitting files, images, messages, or other materials as part of your order, you confirm that:

You retain full ownership of all content you submit. By submitting it, you grant EverStories a limited, non-exclusive license to use that content solely for the purpose of fulfilling your order.

6. Intellectual Property

All website content, branding, design, copy, and imagery belonging to EverStories is our exclusive property and may not be reproduced, copied, or distributed without written permission.

The finished product created from your order is for your personal use only and may not be used for commercial purposes without our prior written consent.

7. Shipping and Delivery

We currently ship within Canada only. Delivery timelines are estimates and may be affected by carrier delays, weather, or other factors outside our control. EverStories is not liable for delays caused by third-party shipping carriers.

Risk of loss and title for products pass to you upon delivery to the carrier. If a package is lost or damaged in transit, please contact us and we will do our best to assist.

8. Limitation of Liability

To the fullest extent permitted by applicable law, EverStories shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our service or products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your order shall not exceed the amount you paid for that order.

9. Disclaimer of Warranties

Our website and services are provided on an "as is" basis without warranties of any kind, either express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
